The President Ratifies the 3rd Amendment To The Judicial Services Commission Act

 Last Thursday, President Ibrahim Mohamed Solih ratified the third amendment brought to the Judicial Services Commission Act (Act No. 10/2008). The amendment bill was passed by the parliament on 17th October 2022 during the 24th sitting of the third session of this year.

The bill stipulates that the Judicial Service Commission’s registration committee must notify the commission of its decision to proceed with or reject a complaint within 14 days since the complaint was made, excluding public holidays.

The bill also allows recipients of complaints 7 days (without public holidays), to submit their defense and recommendations to the investigation committee, effective from the date they receive the receipt of the investigation report. Likewise, the Judicial Service Commission is mandated to hold a hearing within 7 days of receiving the receipt of the defense.

In addition to this, the bill instructs the investigation committee to share the reports with the commission, which will be sending them to the complaint recipient.  Moreover, it also states that the recipient of complaints must be given an opportunity to respond to the investigation report before a ruling is made.

Following the ratification of the amendment, the law was published in the Government Gazette and is now in implementation.
